Probate is broadly understood to be the legal process that is often necessary to settle our financial affairs after we have passed away. However, the Probate Court hears other kinds of cases as well.

Guardianship

Guardianship, in some jurisdictions referred to as guardianship of the person, occurs when the Court appoints one or more people to be responsible for, and make decisions for, another person who may be of any age.

Conservatorship

Conservatorship, sometimes called conservatorship of the estate, or in some jurisdictions guardianship of the estate, arises when one person is appointed by the Court to administer the financial affairs of another person.

Elder Law

Elder Law includes issues that can arise as a senior citizen. One of the most common is guardianship and conservatorship, which can become necessary when we lose capacity to make our own decisions, and we have not already provided for that by the execution of powers of attorney.
